Rules & Regulations

Please read the following terms and conditions carefully before buying an x-access ID or registering yourself as webmaster. The contents of these Rules will be regarded as fully accepted when entering into any buisness relationship with x-access.  

• 1. Applicant represents and warrants that the Applicant is eighteen years of age or older.


• 2. Applicant confirms that the provided email adress belongs to a email post box that allows access for no other person.


• 3. Applicant acknowledges and is aware that x-access my use 2 Cookies. One may be used to store the customer id. The second may contain a PHP Session ID, which is only very temporary valid during one session. Both shall serve customer comfort and security. If allowed by your browser we will show your custumer id in every gate. Please report and do not use any gate that does not show your customer id if your browser allowes cookies. Both may be denied my the browser.


• 4. Applicant confirms that the provided email adress belongs to a email post box that allows access for himself only.


• 5. Declaration concerning data protection: Any personal information beeing provided by the Applicant will not leave our company. There are only two exceptions to this rule. 1. We will transfer customer information to another office beeing responsible of charging customers for unlawfull payment withdraws, but then only those informations which are necessary to disclose. 2. Except in response to legal process. Otherwise x-access will not disclose, disseminate, sell, lease or transfer any private information provided to it by Applicant (or Member) to any third parties. Otherwise, all data, information, compilations, statistical analyses, profiles, membership history and transaction records are the sole and absolute property of x-access.


• 6. Applicant acknowledges and is aware that x-access provides other passes than the Basis Pass (by choice of the webmaster) and that the available sites that Applicant has access on varies depending on the following circumstances: 1. Which passes does the Applicant hold. 2. Which AV method (level) was used by the Applicant.


• 7. Applicant acknowledges and is aware that all passes except the Basis Pass will be activated with the first use thereof (latest after 14 days). This feature was implemented out of customer fairness, also to let Allicants that are using the Face2Face AV method enough time to finish this procedure for access to a special preferred site.


• 8. Applicant acknowledges and is aware that the Face2Face AV method by Postident does cost 10 Euro. This fee will only be charged together with the receiving of the PostIdent material. All other costs will be charged immedeately.


• 9. Applicant acknowledges and is aware that the use of the x-access ID will permit the Applicant to access websites which, in the opinion of the website owner, may contain materials that are not suitable for minors including, but not limited to sexually explicit adult oriented materials, depictions and descriptions of graphic violence, death, mutilation, nudity, simulated or actual sexual acts, auto eroticism, homosexuality and hate speech (Collectively referred to as "Materials").


• 10. Applicant represents and warrants that, in the event Applicant accesses any Materials, that it is lawful to receive and view said Materials in the jurisdiction in which Applicant resides, receives or views said Materials.


• 11. Applicant represents and warrants that, in the event Applicant accesses any Materials, that Applicant will not use the Materials in any unlawful manner, will not display or transmit the Materials to, or allow access of the Materials by, minors, except where such display, transmission or access is permitted by law by a parent or guardian.


• 12. Applicant represents and warrants that, in the event Applicant accesses any Materials, that Applicant will not use the Materials in any manner inconsistent with the intellectual property rights of the owner of the Materials.


• 13. Applicant acknowledges, represents and warrants that, acceptance of the benefits, rights and privileges afforded to Applicant by the x-access Membership are fair and adequate consideration to contractually bind the Applicant to the terms and conditions herein set forth and as may, from time to time, be amended.


• 14. Applicant acknowledges that x-access relies on the representations and warranties made by the Applicant in the Application and these terms and conditions. Applicant represents and warrants that all information provided in the Application is true and correct.


• 15. Applicant acknowledges that x-access may limit ticket sales until the ability to pay is sufficiently verified.


• 16. Applicant is applying for membership to x-access for the purpose of accessing websites which may contain materials that are not suitable for minors and which may contain, among other things, sexually explicit, adult oriented materials. Applicant acknowledges and agrees that x-access does not make any warranties, representations or other assurances whatsoever, express or implied, including any warranty of merchantability or fitness for a particular purpose.


• 17. Upon approval of any Application, the Applicant becomes an lifelong* x-access member ("Member") and shall obtain an x-access PIN which will, for the period of time for which the Applicant has enrolled and for which Applicant has paid, enable the Member to access websites that use the x-access age verification system to restrict access to their websites to adults. Lifelong is defined as 20 years, where your x-access ID will be valid for accessing all x-access standard sites. A change to or the termination of any special programs (ROYAL/Ticket programs) is possible at any time during that period.


• 18. Applicant acknowledges and agrees that x-access protected sites, also the one that was reason for the member to apply for an ID may terminate the usage of x-access at any time or x-access may terminate to support this site at any time. Additionally it may happen that a site changes it's state to be part of another program (Royal/Ticket program). x-access can therefore not garanty that a special offering is always available with your x-access ID.


• 19. An Applicants representations, warranties, acknowledgements and agreements, as herein stated shall continue in force throughout membership and as such the term Applicant and Member shall apply interchangeably.


• 20. Member will not publish, disclose, disseminate or otherwise permit any other person to use his/her x-access PIN and or TANs.


• 21. Member can be held responsible for any misuse that may occure if that member has published, disclosed, disseminated or otherwise permited any other person to use his/her x-access PIN.


• 22. x-access does not guaranty or warrant the compatibility of the Member's equipment, computer or software, including but not limited to, the type of computer, computer configuration, browser software, other software, dial up account, TCP/IP, Winsock or online service. x-access is not responsible for any interruption in service or inability of Member to access participating websites due to technical difficulties or failure of the internet, world wide web, phone lines, switching or any other causes beyond its control.


• 23. All membership fees are non-refundable in the event that any valid membership is cancelled by x-access for violation of these terms and conditions or by Member. If it is determined by x-access, in its reasonable discretion, that the membership was not validly obtained, then x-access will credit the credit card or normal account improperly used for the charges and will invalidate the Membership ID.


• 24. x-access reserves the right to cancel any Membership for any reason, with or without notice, if it determines, in its sole and absolute discretion that Member has violated any of these terms and conditions or does refuse to pay any amount due.


• 25. PLUS/ROYAL Memberships will automatically renew every 30 days. If Member does not wish to renew membership for any successive period, then Member must notify x-access anytime before renewal. Member authorizes x-access to charge any renewals to the credit card or normal account originally provided. The same aplies for all other ticket passes the customer buys.


• 26. Member assumes all risk and accepts all responsibility for any and all use of an x-access Membership, for access to any participating websites and for the use of any Materials or content (including programming, code, software, encryption, data or other information technology) obtained from any participating website.


• 27. Member agrees to indemnify and hold x-access harmless from any liability, damages, claims, actions or suits (including all costs and attorney's fees) arising in any way out of the Member's use of an x-access ID, the receipt, viewing, transmission or retransmission, or use of any Materials or content, or any violation of these terms and conditions.


• 28. Member acknowledges and agrees that these terms and conditions may be changed, modified, amended and/or supplemented by x-access at any time, from time to time, without notice.


• 29. Member further acknowledges and agrees that by applying for or accepting membership to x-access that these terms and conditions shall be construed under and pursuant to the laws of Germany and jurisdiction and venue for any action to enforce, interpret or otherwise dealing with these terms and conditions, x-access or any rights arising herefrom, shall be in Leverkusen, Germany. If any court of competent jurisdiction determines that any part or parts of these terms and conditions are invalid or void, then the remaining part or parts shall remain in full force and effect.


• 30. Member acknowledges, represents and warrants that he/she has read these terms and conditions and agrees to be bound by them as part of and in consideration of the x-access membership.


• 31. x-access is a registered company in the netherlands. All representations, warranties and rights conferred hereunder shall inure to the benefit of the x-access GmbH., its affiliates, successors and assigns.
